Our Terms & Conditions

We aim to provide the very best customer experience we can offer throughout your engagement with us. You make our business work so we work to provide the service you deserve.

Through selling both online and at events nationwide, we follow all recommended guidelines on GDPR and privacy, distance selling regulations, taking pre-orders and managing customers expectations. This is possible through detailing shipping policy, return policy (although we strive to ensure that returns are not necessary), our expectations for customer collections, our Cookie policy and most importantly our policy on pre-ordering from us. Please read on for further information - and if your question isn't answered, please drop us a message through the contact page.

Privacy Policy

At Transport Nostalgia Buses in Miniature, Transport Nostalgia Transport in Motion, Omnidekka Models Buses in the Small World and through our administration of the Nottingham Heritage Vehicles Charity (NHVC) website and socials we treat your privacy seriously. Any information we collect from yourself is solely to enable us to fulfil our service to you, in providing the details we require to supply or respond to any enquiry, relating to our services offered or goods for sale, be they online or in person and for the marketing of our products, feedback, administration, customer support, order management, resolution of order difficulties or supply/shipping issues, to enforce our general policy terms and conditions and to provide the best customer experience possible.

Information we collect will be limited to your name, email address, mobile or contact number, payment information and shipping address. 

All information collected is stored in encrypted secure form on our webhost servers, in line with their own policies and is deleted 24 months after no activity on any registered customer account. An exception to this are the order details, which by law are retained for a period of 6 years for accounting purposes. All payment details are held by our payment gateway providers. This is currently through SumUp but may change in future. You are reminded to check this page regularly for any changes, as we reserve the right to make changes to our policy, without prior notice throughout the term of our business. 

You do have the right to request such information is not held by us, but to fulfil our obligations and the sale process, we require this information - so we would have no option other than to decline your order and refund if payment has been completed. 

Data will be shared with agencies where their primary purpose is law enforcement, including the enforcement of a safe working and protected working environment for any volunteers helping us in our business adventures. Abusive behaviour is not tolerated. Any information given freely to ourselves maybe used where deemed appropriate subject to UK law by our associate trading company or the Charity. 

Furthermore, our server collects data to ensure that spam content for instance is filtered out. This is done through the use of cookies - sadly not chocolate coated ... but this is what we mean by Cookies ....

Cookie Policy

What are Cookies? Cookies are small pieces of data stored on a user's device by their web browser whilst they are browsing a website. They are commonly used for various purposes such as remembering user preferences, tracking user behaviour and providing personalised content. Embedded content from other websites

Articles on this site may include embedded content (e.g. videos, images, articles, etc.). Embedded content from other websites behaves in the exact same way as if the visitor had visited the other website.These websites may collect data about you, use cookies, embed additional third-party tracking, and monitor your interaction with that embedded content. This could include tracking your interaction with the embedded content, if you have an account and you are logged in to that website.

Payments

All our payments are taken through the use of the payment gateway SumUp. The full terms of how they manage your payments are detailed by them and displayed by viewing their terms and conditions on sumup.com. We do not store nor receive any payment card or bank details ourselves at any stage of our engagement with you. We only receive confirmation of, or failure notifications for any sale transaction handled, through SumUp by an email notification to confirm the sale and aid the processing of a sale order. 

Our Pre-Order policy: -

Please note all advertised models where Pre-Orders have been made available, will be arriving in due course. All models prior to TNBUS1 and MMC2 will be handled by the original team, in line with our revised terms and conditions.

Pre-Order costs and postage discounts for multiple orders offered at the time of ordering prior to Transport Nostalgia handling sales will be honoured in full. This relates to already released WSD1/MMC1/CP44101/CP46401 (all variants) and ES-White. In addition it applies to Pre-Orders of WSD2/OM1/OM3 and the GNE Solo SR - so no need to message us as contact will be made upon the postage of these items in due course.

Pre-released orders (“Pre-orders”) are orders for products (“Products”) that are not yet available for general sale from ourselves. A Pre-Order will show as such within the items sale listing. In order to place a Pre-order, you will need to provide certain information, including but not limited to your name, address and billing information. It is your responsibility to ensure this information is accurate and up to date.  If we do not have accurate information, we will not be able to keep you informed. With some product where orders are received from Far Eastern countries through which our manufacturers do not permit us to supply, as an element of stock is retained for sale directly by themselves, we will cancel and refund the pre-order within 3 working days. 

 

Pre-Order Payments

Pre-order payments do not guarantee availability of the Product but represent your offer (“Offer”) to buy the Product when it is generally released for sale.  We reserve the right not to accept your Offer and the your Offer is only accepted once the Pre-ordered product is despatched. 

When you place a Pre-order you will need to pay the full upfront price of the Product. A customer will only be permitted to hold a maximum of £600 of pre-order product with us, with further orders cancelled without prior permission to purchase being granted through a request via our contact page.  You may cancel your Pre-order and get a full refund of your Pre-order Payments at any time before the Product has been despatched.

 

Pre-Order Delivery

Where possible, orders will be shipped to you or be ready for collection as soon as is practicable, subject to availability. For some areas delivery may take longer. (Please see our shipment policy for further details). Release dates are subject to change. As a result, we cannot be liable for any changes to Release dates or Pre-order windows advertised by us in good faith.

 

Pre-Order Cancellation

Either party may cancel a Pre-order at any time for any or no reason prior to our notice to you that the Product has been despatched (“Despatch Notice”). If cancellation occurs before the Despatch Notice, you will be entitled to a full refund by way of our preferred method - a credit voucher, by email to the value of your Pre-order payment. There is an exception to our refund policy relating to any model where a charitable donation is given to any registered Charity upon the placing of the Pre-Order. An example of this is OM3, the Cancer Research model where we donate £5 from every sale to the Charity through a giving page - more detail on this is shown on the sale listing with the link available to cut and paste to view the fundraiser instigated upon release of this Pre-Order. Any customer cancelling a Pre-Order will not be permitted to order the same item again as a new order. We are aware of past instances whereby orders have been cancelled with fellow model providers simply to release funds, with the customer returning to place an identical order again within days. As we are not legally allowed to withhold payment processing fees we cannot allow this practice to take place hence our restrictions on return orders and credit voucher refunds being our preference. 

 

Additional conditions

The purchase of the Product maybe subject to additional terms and conditions, which will be notified to you before you complete your purchase, in your order confirmation. When you buy from our online shop, our online shop purchasing terms will also apply as detailed through other policy conditions highlighted on this page.  

Shipping and despatch policy - The delivery of your Orders....

Below are the delivery services we offer and how they work:-

Collection  - This can be arranged upon notification of model release, from the Nottingham Heritage Vehicles Charity Museum on Portland Road, Hucknall, Notts by prior arrangement. No charge is levied for this service but failure to collect at the pre determined time will result in cancellation and refund of your order at our discretion within 3 working days. To change your order to a despatch via post option will require cancellation of the collection order and placement of a new order where the product remains available to order. 

Royal Mail (UK Only) (Flat Rates detailed upon purchase)

All orders are sent by a fully tracked 48 hour service providing us with proof of delivery by photo confirmation and a signature on delivery where a Safeplace delivery isnt opted for. SMS or email notifications are sent to recipients. Orders are tracked to the stated delivery point and the Royal Mail aim to deliver in a maximum of two to three working days but do not guarantee this. Your order is insured appropriately. Furthermore customers can change delivery options with the Royal Mail prior to any delivery attempt.  Please refer to the Royal Mail for further details relating to maximum delivery times and changes to service levels during periods of severe weather for instance. 

Royal Mail (Overseas)

All overseas orders are sent by Royal Mail International tracked services and are aimed be to delivered within 15 working days (3 weeks) For any international order please message to obtain the postage costs which will be requested following order placement by means of a seperate invoice. Please refer to the Royal Mail International Services online pages for further details relating to maximum delivery times and changes to service levels during periods of severe weather or conflict for instance. 

Our Returns and Cancellation Policy

Under the Distance Selling Regulations you can cancel your order with us within 30 days of purchase. If 30 days have passed since your purchase, we can not offer you a full refund or exchange. Please notify us via email or our website contact page to advise us that you wish to return your order and to receive authorisation and instructions for the return.

Items should be returned in the original packaging, together with a copy of your order or receipt. We require you to  obtain proof of postage and to send by a tracked service matching that used by ourselves for the initial posting out of your order, (this is in case of any query - as we cannot be held responsible for the non-delivery of returned items).

Please note any Gift cards we may offer for sale are NOT eligible for refund under any circumstances. Sale items or items sold detailing any fault or damage are regarded as sold as seen and not open to any refund.

The item must be packaged securely and returned to us in its original condition within 30 days of the date of the original order. Once your return is received and inspected, we will send you an email to notify you that we have received your returned item.

We reserve the right to refuse a refund on any item that is returned in a less than saleable condition.

Providing the goods are returned in a fully saleable condition, a full refund for the cost of the item(s) will be made. This does not include delivery costs. We will notify you of the approval or rejection of your refund. If you are approved, then your refund will be processed, and a credit will automatically be applied to your credit card or original method of payment, within a 7 day period excluding public holidays. Please note refunds to credit card issuers sometimes incur a short delay before the credit shows on your account. 

If you receive a faulty or damaged item, or if an incorrect item was supplied, we will send a replacement or issue a full refund upon verification (including shipping costs). Please contact us via email or our website ‘get in touch’ page to advise us of the problem and to receive authorisation and instructions for the return. In the case of damaged items, photographic evidence of the item and original packaging will be required before any claim procedure can begin. No photographic evidence of damage, alongside the original packaging at the time of tracked parcel delivery will invalidate any claim for a refund or replacement. 

If the item was marked as a gift when purchased and shipped directly to you, you’ll receive a gift credit for the value of your return. Once the returned item is received, a gift certificate will be emailed to you.

If the item was not marked as a gift when purchased, or the gift giver had the order shipped to themselves, to give to you later, we will send a refund to the gift giver and they will be fully aware of  the items return.

We reserve the right to amend these Terms. Please check our website regularly to ensure you are updated with our policies and any changes implemented.

These Terms are governed according to English law.  Any disputes or proceedings shall be subject to the exclusive jurisdiction of the English Courts by English law.
